IRS Announces Mid-Year Increase to Business Mileage Reimbursement to 58.5 Cents

 

The IRS recently announced a major increase to the optional standard business auto mileage reimbursement rate for July 1 through December 2008.  This new reimbursement rate, 58.5 cents per mile (an increase from 50.5 cents for the first 6 months of 2008), marks the second time in recent years that the IRS has made mid-year adjustments.  The last adjustment was in September 2005 to reflect higher gas prices resulting from Hurricane Katrina; that rate was subsequently lowered in January 2006.

 

This increase is a direct result of increased gasoline prices, a change in how the IRS bases its rate adjustments.  Typically, the tax agency bases the reimbursement rate on an annual study of what it costs to operate an automobile.

 

Reimbursement to employees for business use of private automobiles is not mandatory, but is typically a matter of company policy, recognizing the additional wear and tear caused with this additional use.  Reimbursing an employee more than the IRS optional mileage allowance (58.5 cents) should be treated as income to the employee, subject to withholding and employment taxes.

 

Additionally, the IRS changed the medical and moving expense reimbursement to 27 cents per mile, paid to or incurred by an employee after July 1, 2008.

New Form I-9

 

The Department of Homeland Security, U.S. Citizenship and Immigration Services has released the updated Employment Eligibility Verification Form I-9.  This Form I-9 has an expiration date of 6/30/2009.  All U.S. Employers are responsible for completion and retention of Form I-9 for each individual hired or employed in the United States, including citizens and noncitizens.  No Form I-9 prior to version dated 6/05/07 will be accepted.

 

Form I-9 must be kept by the employer for either three years after the date of hire or for one year after employment is terminated, whichever is later.  Forms must be available for inspection by authorized U.S. Government officials, e.g., Department of Homeland Security, Department of Labor or the Office of Special Counsel.

 

The 6/30/2009 version appears to be identical to the previous version, 6/30/2008, which was substantially different any previous versions.  Be sure to read the instructions for those employers who participate in the E-Verify program.
